2. Goods category regulations require specialized inspection

4. What is the principle of inspection of imported and exported goods?
Typically, the specialized inspection of export goods and imports is based on the following principles: risk management, imports, transit, individual to ensure effectiveness, state management validity, assessing the degree of compliance with specialized legislation of the organization, and facilitating export activities.
Pursuant to Article 21 of Decree 85/2019/ND-CP:

These certifications must be applied to advanced management systems in accordance with international and regional standards as prescribed by the Department of Industry Management.
- Goods with appropriate evaluation results are recognized under international treaties to which the Socialist Republic of Vietnam is a party.
- In accordance with the provisions of the law, goods included in the category of export goods and imports must be checked in advance. And goods included in the category of imported goods must be inspected after approval and must meet all of the following requirements:
- In accordance with the provisions of specialized law as well as the catalog of goods imported and exported in Vietnam. The goods must have a detailed name along with the appropriate HS code for each product.
- Goods must have the corresponding standards and technical regulations. And applied to inspection items as the basis for inspection of goods;

- Goods included in the category of imported goods must be subjected to specialized inspection prior to registration. 5. Are imported and exported goods exempt from inspection at check-in?
Article 22 of Decree 85/2019/ND-CP provides for exemption from specialized prior examination as follows:
- Items in this group are regulated by international treaties to which the Socialist Republic of Vietnam is a party. And the items are exempt from inspection as required by law.
- In addition, the state inspection exemption applies to the food safety sector in the following cases:
- Under the provisions of the tax law, goods imported by post or forwarding of customs value will be exempt from customs duty.
- Goods imported under the categories and quantities exempt from duty in accordance with the provisions of the law for the purpose of serving the business and activities of foreign organizations are entitled to diplomatic immunity.
- The baggage of the person entering is subject to duty exemption.
- The goods of the business are exported and imported on site.
- In addition to the exemption cases referred to in paragraph 1 of the article, the following exemptions may also be applied:
- The imported goods of the enterprise sent by post or forwarding of customs value shall be exempt from duty in accordance with the provisions of the law.
- Goods from temporary imported enterprises for sale at duty-free stores.
- The goods of the business are exported and imported on site.
- With the provisions of clauses 1, 2, and 3, if the ministers of industry or sector issue warnings for goods that are not eligible for food safety, harm to health, pollution of the environment, human life, spread of diseases, hazard to the economy, national security, affect social morals, or purity, Or goods whose written notification ceases to apply the specialized pre-examination exemption regime will not be applied under Article 21.
6. What factors must imports and exports check?
In accordance with Article 3 of Decree No. 08/2015/ND-CP, the imported and exported goods of the specialized inspection group must be checked for the following elements as prescribed by the law:
- Product quality.
- Medical.
- Culture.
- Animal screening.
- Plant inspection.
- Food safety.

7. Where must imported and exported goods under inspection be stored?
Pursuant to Article 33, Paragraph 3, of Decree No. 08/2015/ND-CP, as amended by Article 16, Paragraph 1, of Decision No. 59/2018/ND-CP, which provides for export goods and imports subject to specialized inspection as follows:
- The goods must be stored at the gate, the port of export and import established in the country.
- The goods must be stored in a customs warehouse.
- The goods must be stored at the inspection center for exports and imports.
- Imported and exported goods shall be subject to customs supervision until approval.

- According to the provisions of the law on checks, goods imported and exported must be returned to locations for domestic checks.
