“In case goods originating from an FTA member country are brought into a Vietnamese bonded warehouse by a foreign trader and then re-exported to another FTA member country, the foreign trader can authorize for their representative in Vietnam to request a back-to-back C/O according to the provisions of Clause 17, Article 3 and Article 20 of Decree No. 31/2018/ND-CP dated March 8, 2018 of the Government detailing regulations. Law on Foreign Trade Management on Origin of Goods. The authorization must be made in writing according to the provisions of civil law. Accordingly, the authorization document must determine the scope of authorization and the authorization term.

Authorized Vietnamese traders can sign applications for back-to-back C/Os on behalf of foreign traders but must not be shown as the exporter in Box 1 of the C/O. In case of declaration on C/O, it is necessary to clearly state that the Vietnamese trader is authorized on behalf of the foreign trader.

The foreign trader (exporter) in box 1 of the back-to-back C/O issued by Vietnam and the foreign trader (importer) in box 2 of the C/O issued by the first exporting country must be a legal entity headquartered in an FTA member country in which Vietnam participates.”
