1. Concept and category of non-trade goods

2. Preparation of documentation for non-commercial import procedures

On April 1, 2015, import customs procedures for the non-commercial will be made on the VNACCS system in accordance with Circular 38/2015/TT-BTC. At customs branches, businesses and individuals handle the import processes for non-commercial products. When preparing paperwork, importers need to pay attention to the following documents:

  • Customs declaration: In compliance with Clause 2, Article 25 of Decree 08/2015/ND-CP, customs declarations must be made truthfully and precisely. The import goods declaration should be submitted in two original copies using form HQ/2015/NK Appendix IV, which was released together with Circular 38/2015/TT-BTC.
  • Bills of lading or other transport documentation attest to non-commercial goods exchanges.
  • Passport, Visa, or Temporary Resident Card, and one notarized copy of the labor contract (for foreign workers in Vietnam).
  • One copy of the household registration, notarized (for Vietnamese persons).
  • The service provider has one notarized copy of the importer's authorization letter.

To the tax-free list products, importers must, however, add:

  • The Ministry of Finance's tax exemption paperwork applies to gifts or items with a value under the prescribed amount.
  • One original permission document copy in case it is needed by another customer.

3. What is the non-commercial import procedure?

3.1. Register the statement

4. What about the non-commercial import policy?

5. Non-trade import duties

  • Import duty: This is the duty applied to all goods imported into the Vietnamese market. The tariff depends on the type of goods and the country of origin.

  • VAT - Value Added Tax: This is the rate of value-added duty applied to goods in the process of importing and distributing products. The value added tax rate in Vietnam is 10% and can vary flexibly depending on the Government.

  • Special consumption tax: Only applicable to certain specialty items such as cigarettes, gasoline, cars, beers, etc.

6. How to Calculate Non-Commercial Import Duties
