EXPORTING TEXTILE PRODUCTS TO THE UNITED STATES

1. General introduction

2. Requirements for textile products exported to the United States

On April 20, 2010, the Ministry of Industry and Trade issued Circular No. 16/2010/TT-BCT on granting codes of textile and garment manufacturers exporting to the US market. In particular, enterprises producing textiles and garments when exporting to the US market for the first time are required to register for a Manufacturer Identification Number (MID).

3. How to determine the MID manufacturer code

To generate a Manufacturer Identification code (MID code), a business must provide its full name and postal address. Once all that information is available, the MID code is determined in the following order:

Find the two-letter ISO code for your supplier's country, for example GB for the UK, NL for the Netherlands and DE for Germany

Get the first three letters of the name and the second name of the manufacturer (if applicable)

Get the highest digits (up to four) from the address line

Take the first three letters of the manufacturer's city name

4. Application for MID code

To register for the MID Code, businesses must prepare a set of documents including the following documents:

Application for registration of manufacturer identification number (MID) to the US market (according to form).

Business registration certificate (or investment certificate, or business license): 01 (one) copy certified and stamped to copy the original by the trader.

Tax code registration: 01 (one) copy certified and stamped as true copy of the trader.

Minutes of production capacity inspection chaired by the local Department of Industry and Trade in coordination with the Department of Planning and Investment: 01 (one) original copy.

Note: In case the dossier does not have enough documents, the Regional Import-Export Management Department must return the dossier with a written notice clearly stating the reason. Traders doing pure commercial business, not directly producing textiles and garments, when entrusted with export, must declare the MID code of the manufacturer of the shipment. Textile goods with incorrect production codes will be invalid and US Customs will refuse import.

5. Check textile and garment production capacity when registering for MID code

5.1. Inspection principles

Timely inspection, without prior notice (enterprises can only notify at most 02 hours before the delegation arrives), except in cases where the enterprise requests the inspection itself.

5.2. Organize inspection team

The Department of Industry and Trade is the focal point and presides over coordination with the Department of Planning and Investment to establish a concurrent interdisciplinary inspection committee, in which each agency will have at least 02 members (can replace each other) to participate in the delegations. interdisciplinary examination.

5.3. Procedures and content of inspection

When working with the delegation, the delegation leader handed over a decision from the Department of Industry and Trade to establish an inspection delegation for that enterprise.

The delegation confirmed the enterprise's garment production capacity and updated the Inspection Record according to form No. 02 attached to Circular No. 16/2010/TT-BCT .

Inspection work is carried out in accordance with regulations, without causing any hindrance to the enterprise's production.

Enterprises are required to strictly comply with inspection regulations and send competent representatives to cooperate with the delegation immediately upon receiving notification by phone or when the delegation arrives at the facility. Enterprises must provide all records on the management of machinery, equipment, and labor and bring the inspection team directly to warehouses and factories, signing the inspection record.

The minutes are made into 05 copies: 01 copy is kept by the enterprise, 01 copy is kept at the Department of Industry and Trade, 01 copy is kept by the Department of Planning and Investment, 01 copy is sent to the Import-Export Management Department, and 01 copy is sent to the Department of Planning and Investment. 6. Sequence & time of issuance of MID codes

Enterprises submit applications directly at the Import-Export Management offices or submit them by post. The Regional Import-Export Management Department checks the validity and completeness of the dossier.

Issuance of MID code is carried out no more than 03 working hours from the time the Regional Import-Export Management Department receives a complete and valid dossier.
